Terms of Service — Hyper Store

These Terms govern use of the Hyper Store platform, operated by ANAVTEK LLC d/b/a Hyper Digital Agency ("Hyper Store", "we", "us"). By creating an account you agree to these Terms.

1. The service

Hyper Store is a white-label platform that lets creators build a storefront and sell digital downloads, lead magnets, links, bookings, and (later) courses, memberships, and more. We provide the software; you (the creator) run your own store and sell your own products.

2. Accounts & eligibility

You must provide accurate information and keep your credentials secure. You must be at least 18 years old and able to form a contract. We may require email verification before you can publish a store.

3. Subscription, trial & billing

  • Hyper Store is offered on a single plan: $29 per month or $290 per year.
  • New accounts get a 14-day free trial. A payment card is required to start the trial. You will not be charged until the trial ends; we send a reminder before the first charge.
  • Subscriptions auto-renew each period until cancelled. You can cancel anytime in Plan & Billing; cancellation stops future charges and takes effect at the end of the current period.
  • Fees are non-refundable except where required by law or at our discretion. Billing runs on our Stripe account; taxes on the subscription itself, if any, are handled at checkout.

4. Your sales, your Stripe, your responsibility (merchant of record)

  • You connect your own Stripe account to receive your sales. You are the merchant of record for every sale you make and are solely responsible for your products, fulfillment, customer service, refunds, chargebacks/disputes, and payouts.
  • Hyper Store takes no fee on your sales and never holds your sales funds — you keep 100% (less your own Stripe processing fees).
  • You are solely and permanently responsible for any sales tax/VAT on your sales. We provide no tax calculation, collection, or remittance for your sales.

5. Your content & customers

You retain ownership of your content and your customer relationships. You grant us the limited license needed to host, display, and deliver your store and products, and to operate the service. Your buyers' data is yours; we process it as your processor under our Privacy Policy.

6. Acceptable use

You may not use Hyper Store to sell illegal goods/services, infringe others' rights, distribute malware, defraud buyers, or abuse the platform (including signup/trial abuse or payment testing). We may investigate and act on violations, including suspension (see §8). You are responsible for complying with all laws applicable to your business.

7. Fraud & platform protection

To protect creators, buyers, and the connected Stripe accounts, we apply anti-abuse measures (email verification, velocity limits, CAPTCHA, and card-testing protection). These may briefly pause checkout on a store when suspicious activity is detected.

8. Suspension, lapse & offboarding (handled humanely)

  • If your subscription payment fails, we first prompt you to update your card while your storefront stays live; after a grace period an unresolved lapse moves your store to read-only / "taking a break." We do not delete your store or data over billing.
  • On account closure/offboarding we provide a wind-down window: you can export your data (products, customers, orders, email lists), buyers with paid access are notified and can download their purchased content, and you can release your custom domain.
  • We may suspend or terminate accounts that violate these Terms.

9. Availability & disclaimers

The service is provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, we disclaim implied warranties.

10. Limitation of liability

To the maximum extent permitted by law, Hyper Store is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amounts you paid us for the subscription in the 12 months before the claim. We are not a party to, and not liable for, transactions between you and your buyers.

11. Changes

We may update these Terms and will post the new date above; material changes will be notified. Continued use after changes means acceptance.

12. Governing law & contact
